Publish My app Terms of Service and Publishing Services Agreement

1. General
Welcome to Publish My app.
Publish My app provides professional services relating to developer account setup, application review, application preparation, Google Play and App Store publishing, release management, and related technical services.
By accessing publishmyapp.io, submitting your details, making a payment, ordering a service, or providing an Application, source code, or other materials to Publish My app, you agree to these Terms.
If you do not agree to these Terms, you must not purchase or use the Service.
If you act on behalf of a company, organization, or another person, you represent that you have authority to bind that party.

3. Services
Publish My app may provide:
Google Play Managed Publishing services;
Android application eligibility reviews;
Source code and technical reviews;
Google Play submission services;
Assistance establishing a new Apple Developer Program membership dedicated to a Customer;
Apple Developer account setup services;
Combined Apple Developer account setup and App Store publishing services;
Store listing preparation;
Metadata preparation;
Application submission;
Release management;
Application updates;
Other professional or technical services offered through the Website.
4. Google Play and App Store Use Different Models
Our Google Play and App Store services operate differently.
Google Play applications may be published through managed publishing infrastructure operated by Publish My app.
For App Store services, our intended model is to establish a new Apple Developer Program membership dedicated exclusively to the relevant Customer.
We do not intend to publish applications belonging to unrelated customers through the same Apple Developer account under this service.
5. Google Play Managed Publishing
The Google Play Service is a managed publishing service.
The Customer does not acquire ownership of a Publish My app Google Play Developer account and does not automatically receive account credentials or administrative control.
Publish My app manages the publishing environment and may determine which eligible publishing account is used, subject to Google Play requirements and our technical, operational, security, and business considerations.
6. Google Play Account Health
Access to our Google Play publishing infrastructure is subject to strict screening.
No Customer has an automatic right to publish an Application through our infrastructure.
Publish My app may reject, delay, suspend, or remove an Application if we reasonably believe it may create a risk to an account, users, Publish My app, or a third party.
7. Google Play Application Review
Our review process may include:
Initial qualification;
Paid extended review;
Source code analysis;
APK or AAB analysis;
Permission review;
SDK review;
Dependency review;
WebView review;
Data Safety review;
Privacy Policy review;
Copyright and trademark review;
Previous publishing history;
Previous rejection or suspension history;
Functionality review;
Malware screening;
Google Play policy risk review.
8. Google Play Review Fees
The Extended Review is a professional paid service.
The price displayed at checkout is the applicable price for that order.
Where the review fee is stated to be credited toward publishing, the credit applies only if:
Publish My app internally approves the Application;
the Customer purchases the publishing service;
the Customer pays the remaining publishing balance.
The Extended Review is a standalone professional service.
Rejection following a completed review does not automatically create a right to a refund.
Mandatory legal rights remain unaffected.
9. No Google Play Approval Guarantee
Publish My app does not guarantee:
Google Play approval;
a particular approval date;
future exemption from testing requirements;
production access;
ranking;
downloads;
revenue;
search position;
continued availability;
absence of future enforcement.
Google controls its own decisions.
10. Apple Developer Program Service
A Customer requesting App Store services may select:
Option 1:
New dedicated Apple Developer Program account setup.
Option 2:
New dedicated Apple Developer Program account setup plus iOS application preparation and App Store submission services.
The Customer selects the desired option through the Website and is charged according to the prices active in our back-office system at the time of purchase.
11. Dedicated Apple Developer Account
Our Apple service is designed around establishing a new Apple Developer Program membership dedicated exclusively to the Customer.
Publish My app will not use that account to publish applications belonging to unrelated customers.
The account is intended solely for the Customer's activity, subject to Apple's requirements.
12. Apple Account Holder Identity
Apple may require a membership to be registered to the actual legal person or legal entity using it.
For Individual memberships, Apple may verify the individual's legal identity.
For Organization memberships, Apple may require information including:
Valid legal entity status;
D-U-N-S Number;
Legal entity name;
Business address;
Functional website;
Business email address;
A person with legal authority to bind the organization;
Identity verification;
Business documentation;
Telephone or other verification.
Customer must provide truthful and accurate information.
13. Actions the Customer Must Complete
Apple may require certain actions to be completed personally by the Account Holder or authorized representative.
These may include:
Identity verification;
Two-factor authentication;
Telephone verification;
Device verification;
Acceptance of legal agreements;
Tax agreements;
Banking agreements;
Program license agreements;
Confirmation of authority to bind an organization;
Direct payments to Apple;
Any other action Apple requires from the Account Holder.
Publish My app may assist, guide, and prepare the Customer, but we do not guarantee that we can perform an action that Apple requires the Customer to perform personally.
14. No Impersonation
Publish My app will not be required to:
Impersonate a Customer;
Provide false documentation;
Provide false information to Apple;
Circumvent identity verification;
Circumvent two-factor authentication;
Misrepresent ownership of a company;
Fabricate a D-U-N-S Number;
Fabricate legal documentation;
Circumvent Apple requirements.
15. Apple Developer Account Only Service
A Customer selecting the account-only option purchases professional assistance with establishing a new Apple Developer Program membership.
The Service may include:
Preliminary eligibility review;
Account structure guidance;
Guidance regarding the appropriate Apple Account;
Enrollment assistance;
Completion guidance;
Verification assistance;
Support through the enrollment process to the extent reasonably within Publish My app's control.
Final acceptance is determined by Apple.
16. Apple Developer Account Plus App Submission
Under this option, Publish My app additionally provides technical services relating to preparation and submission of the Customer's iOS Application.
The Apple Developer account remains dedicated exclusively to the Customer.
Publish My app may be granted appropriate App Store Connect or Apple Developer Program access to perform technical work.
Customer agrees to provide reasonable permissions needed to deliver the Service.
17. Publish My app Access to Apple Accounts
Where reasonably necessary, Customer may add Publish My app or its representative as an:
Admin;
App Manager;
Developer;
Marketing user;
or another appropriate role.
We will seek only access reasonably required for the agreed services.
The Customer or an authorized person acting for the Customer will remain the Account Holder unless Apple expressly permits and approves otherwise.
18. Apple Service Payments
The Customer is charged according to the selected package and the price shown at checkout.
The total price may include:
Publish My app service fees;
Account setup services;
Apple Developer Program fees;
Application submission services;
Preparation services;
Third-party charges;
Applicable taxes.
The checkout page will display the applicable amount.
19. Apple Fees
Membership fees and other payments charged by Apple are subject to Apple's own terms.
Where Publish My app pays an Apple fee on behalf of Customer, that payment may constitute a third-party expense incurred for Customer and may become non-refundable after being paid to Apple unless Apple provides a refund or applicable law requires otherwise.
20. Apple Enrollment Approval
Publish My app does not guarantee that Apple will approve an enrollment.
Apple may reject, delay, investigate, or request additional information.
Reasons may include:
Identity verification issues;
Inconsistent information;
D-U-N-S issues;
Legal entity issues;
Lack of legal authority;
Unsupported jurisdiction;
Previous Apple history;
Payment issues;
Additional documentation requests;
Apple's independent decision.
21. Responsibility for Enrollment Rejection
If enrollment fails because Customer supplied inaccurate, incomplete, misleading, or unverifiable information, this will not constitute a failure by Publish My app.
Where professional work has already been performed, Publish My app may charge for work already completed.
Third-party payments are subject to the relevant third party's terms.
Mandatory legal rights remain unaffected.
22. No App Store Approval Guarantee
Establishing an Apple Developer membership does not guarantee that any particular Application will be approved.
Apple independently performs App Review.
Publish My app does not guarantee:
App Store approval;
review timing;
absence of rejection;
absence of guideline violations;
absence of future removal;
absence of account investigation.
23. iOS Application Review
If Customer purchases publishing assistance, Publish My app may review:
Source code;
Builds;
Dependencies;
Entitlements;
Permissions;
Privacy manifests;
SDKs;
Store metadata;
Screenshots;
Application functionality;
Login flows;
Subscriptions;
In-app purchases;
Privacy Policies;
Tracking;
App Tracking Transparency implementation;
Third-party services;
Intellectual property;
Previous App Store history.
24. Right to Refuse an Application
The purchase of an Apple Developer account setup service does not obligate Publish My app to publish every Application.
We may refuse an Application involving or reasonably suspected of involving:
Malware;
Spyware;
Phishing;
Fraud;
Credential theft;
Impersonation;
Copyright infringement;
Trademark infringement;
Deceptive functionality;
Hidden functionality;
Illegal services;
Unauthorized tracking;
Stolen content;
Misleading claims;
Unlawful financial activity;
or another unacceptable risk.
25. Sensitive and Regulated Categories
Applications involving:
Gambling;
Financial services;
Lending;
Cryptocurrency;
Healthcare;
Medical services;
VPN services;
Dating;
Children;
User-generated content;
Investments;
Insurance;
Payments;
may require additional screening, documentation, licenses, or may be rejected.
Publish My app does not guarantee acceptance.
26. AI and Vibe-Coded Applications
Applications created using Vibe Coding, AI, Generative AI, or code assistants remain fully subject to these Terms.
Customer remains responsible for ensuring the code:
Is lawful;
Is not malicious;
Does not infringe third-party rights;
Does not contain stolen credentials;
Uses properly licensed components;
Behaves materially as represented to Publish My app.
27. Full Disclosure Requirement
Customer must disclose if the Application:
Was previously rejected;
Was previously removed;
Was previously suspended;
Was associated with a terminated developer account;
Received a policy warning;
Received a copyright complaint;
Received a trademark complaint;
Was involved in legal proceedings;
Uses remote code;
Can materially change functionality remotely;
Uses significant WebView functionality;
Processes sensitive information;
Contains functionality not visible during ordinary review.
Material concealment may result in immediate termination.
28. Post-Review Changes
Customer must not materially alter an Application after review without informing Publish My app.
Material changes include:
New SDKs;
New permissions;
New payment flows;
Remote code;
New WebViews;
New tracking;
New functionality;
A changed business model;
A new content category.
Additional review and fees may apply.
29. Application Updates
Publishing one version does not obligate Publish My app to publish future versions.
Updates may require additional review and fees depending on the selected service.
30. Customer Intellectual Property
Customer retains ownership of its Application and Customer Materials.
Customer grants Publish My app a limited license to perform actions reasonably necessary for the Service, including:
Review;
Build;
Signing;
Upload;
Submission;
Display;
Distribution;
Update;
Maintenance.
This license does not transfer ownership.
31. Ownership Representations
Customer represents that:
Customer owns the Application or is authorized to act for the owner;
Customer may lawfully provide the source code;
Customer may lawfully use all logos, images, music, video, text, and content;
Customer holds required licenses;
Customer is not knowingly asking Publish My app to publish stolen or infringing content.
32. Store Information
Customer is responsible for the accuracy of information supplied to Publish My app, including:
App name;
Description;
Screenshots;
Privacy Policy;
Target audience;
Data Safety;
App Privacy;
Permissions;
Advertising;
Tracking;
Content rating;
Claims;
Contact information.
33. Application User Privacy
Customer remains primarily responsible for its own privacy obligations and the privacy practices of its Application.
Publish My app does not become the controller of the Application's end-user information merely by providing publishing services.
34. Test Credentials
Where an Application requires login, Customer may need to provide a dedicated test account.
Customer should not provide:
Banking passwords;
Seed phrases;
Private keys;
Unnecessary personal Apple passwords;
Unnecessary personal Google passwords;
Credentials unrelated to the Service.
35. Apple Passwords and 2FA
Where reasonably possible, Publish My app will not request permanent storage of Customer's primary Apple Account password.
Customer must personally complete two-factor authentication and identity verification when Apple requires it.
If temporary access is expressly required and agreed, Customer should use restricted credentials and rotate them after they are no longer needed.
36. Payment
Unless otherwise stated, services are paid in advance.
Publish My app may refuse to begin work until payment has been successfully received.
37. Pricing
The price displayed to Customer at checkout is the applicable price for that order.
Publish My app may change future pricing.
38. Cancellation
Cancellation requests are handled according to the status of the Service and applicable law.
Where work has commenced, Publish My app may charge for work already performed.
Non-refundable third-party costs may not be refundable.
Mandatory consumer rights remain unaffected.
39. Refunds
Subject to applicable mandatory law:
Completed reviews are non-refundable;
Completed setup work is not automatically refundable;
Google or Apple rejection does not itself create a right to a refund;
payments already made to Apple or another third party are subject to that provider's terms.
40. Chargebacks
Customers who believe a charge is incorrect should first contact billing@publishmyapp.io.
A fraudulent or knowingly unjustified chargeback after receiving services may result in suspension and enforcement of Publish My app's rights.
This does not restrict legitimate statutory rights.
41. Processing Times
Any processing time communicated by Publish My app is an estimate unless an express written SLA applies.
Google and Apple review times are outside our control.
42. Platform Changes
Google and Apple may change:
Enrollment requirements;
Verification;
Testing;
Review guidelines;
Fees;
API requirements;
Privacy requirements;
Account requirements;
Payment requirements;
Store requirements.
Publish My app is not responsible for third-party policy changes.
43. Account Suspension or Termination
Google or Apple may restrict, suspend, or terminate accounts.
Publish My app does not guarantee this will never occur.
Under Google Play Managed Publishing, an Application can be affected by an account-level event.
Under Apple services, because the account is dedicated to Customer, the risks and consequences associated with that membership relate to Customer's account.
44. Protective Action
Publish My app may suspend work, delay submission, remove an Application, or terminate Service where we reasonably identify:
Malware;
Fraud;
Policy risk;
Legal risk;
Privacy risk;
Intellectual property risk;
Account health risk;
Non-payment;
Misrepresentation;
Security incidents.
45. Emergency Protective Action
Where immediate action is reasonably necessary to protect an account, users, Publish My app, or a third party, we may act before receiving Customer's response.
46. Third-Party Complaints
Where we receive a complaint involving:
Copyright;
Trademark;
Privacy;
Fraud;
Abuse;
Security;
Legal demands;
we may suspend work and request evidence or clarification.
47. Appeals
Appeal services are not automatically included.
Appeal work may require an additional fee.
No appeal result is guaranteed.
48. Publish My app Intellectual Property
The Publish My app brand, Website, design, software, systems, forms, workflows, content, and marketing materials are protected.
They may not be copied or commercially used without authorization.
49. Confidentiality
Publish My app will use Customer Materials only as reasonably necessary to provide the Service, protect systems, handle disputes, and comply with applicable law.
Confidential information is handled in accordance with our Privacy Policy and applicable agreements.
50. Source Code Security
Publish My app will use reasonable safeguards intended to limit unauthorized access to source code.
No technological system is completely secure.
Customer must maintain its own independent source code backup.
Publish My app is not a backup service.
51. Service Providers
We may use service providers for:
Hosting;
Payment processing;
Security;
Code analysis;
Email;
Storage;
Analytics;
Communications;
Development.
52. Payment Providers
Payments may be processed through Allpay or another payment processor.
Publish My app generally does not store Customers' complete payment card numbers.
53. Monetization
Publishing services do not automatically include management of:
In-app purchases;
Subscriptions;
Banking;
Tax;
Payouts;
Advertising revenue.
Separate arrangements may be required.
54. Responsibility to End Users
Publish My app is not a party to the relationship between Customer and Application users.
Customer is responsible for:
Customer support;
Refunds;
Privacy;
Terms of Use;
User data;
Content;
Regulatory compliance;
Product claims.
55. No Legal Advice
Policy, privacy, intellectual property, or technical compliance reviews do not constitute legal advice.
56. No Business Performance Guarantee
Publish My app does not guarantee:
Downloads;
Revenue;
Profit;
ASO rankings;
User acquisition;
Conversion rates;
App Store ranking;
Google Play ranking.
57. Service Provided As Available
To the maximum extent permitted by law, the Service is provided on an AS IS and AS AVAILABLE basis.
Publish My app does not guarantee uninterrupted or error-free operation.
58. Limitation of Liability
To the maximum extent permitted by applicable law, Publish My app will not be liable for indirect, special, incidental, or consequential damages, lost profits, lost revenue, lost rankings, lost users, or business losses resulting from a decision or failure by Google, Apple, or another third party.
To the extent permitted by law, Publish My app's aggregate liability relating to a particular order will not exceed the amount actually paid to Publish My app for that order during the 12 months preceding the event giving rise to the claim.
Nothing excludes liability that cannot legally be excluded.
59. Indemnification
To the extent permitted by law, Customer agrees to indemnify Publish My app against claims, liabilities, penalties, damages, and reasonable expenses arising from Customer's conduct, including:
Intellectual property violations;
Malicious code;
Illegal content;
False information;
Privacy violations;
End-user claims;
Platform policy violations caused by Customer;
Breach of these Terms.
60. Termination
Publish My app may terminate or suspend a Service for:
Breach;
Non-payment;
Fraud;
Misrepresentation;
Security risk;
Legal risk;
Platform risk;
Failure to cooperate;
Inability to continue providing the Service.
61. Effect of Termination
After termination, Publish My app may, where applicable:
End support;
Stop updates;
Revoke access;
Remove itself from Customer's Apple account;
Remove an Application from our Google managed publishing infrastructure where appropriate and permitted;
Delete materials according to our retention policy;
Retain records required for law, security, fraud prevention, or disputes.
62. Apple Account After Termination
Under the Apple service, Customer's dedicated Apple Developer account does not become property of Publish My app because the Service ends.
Publish My app may remove its own access following termination.
Customer thereafter remains responsible for renewals, agreements, banking, tax, certificates, and continuing management.
63. Apple Developer Program Renewal
Customer is responsible for maintaining an active Apple Developer Program membership after the applicable service period unless Customer separately purchases renewal management services.
Initial setup fees do not include perpetual annual renewal.
64. Force Majeure
Publish My app is not responsible for delay caused by circumstances outside its reasonable control, including:
War;
Terrorism;
Natural disasters;
Cyberattacks;
Cloud outages;
Apple outages;
Google outages;
Communications failures;
Government actions;
Payment provider failures.
65. Changes to Services
Publish My app may update workflows, services, pricing, requirements, and supported Application categories.
Existing paid orders remain subject to their applicable terms and mandatory law.
66. Changes to These Terms
We may update these Terms from time to time.
The current version will be published on the Website.
67. Entire Agreement
These Terms, the Privacy Policy, checkout information, order details, and any separate written agreement constitute the agreement between Customer and Publish My app.
A specific signed agreement controls regarding any subject it expressly governs.
68. Assignment
Customer may not transfer this Agreement without Publish My app's approval.
Publish My app may assign the business relationship as part of a merger, business sale, corporate restructuring, or transfer of the Service.
69. No Partnership
The relationship does not create a:
Partnership;
Joint venture;
Employment relationship;
Agency;
Fiduciary relationship.
70. Severability
If a provision is held unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.
71. No Waiver
Failure to enforce a right on one occasion does not waive that right.
72. Governing Law
These Terms and the Service are governed by the laws of the State of Israel, subject to mandatory consumer protections and other rights that cannot legally be waived.
73. Jurisdiction
Subject to mandatory law, disputes will be subject to the competent courts of Tel Aviv-Jaffa, Israel.
74. Dispute Resolution
Before initiating formal proceedings, the parties are encouraged to attempt good-faith resolution through:

75. Language
These Terms may be available in Hebrew and English.
If a material inconsistency exists, the English version will control to the extent permitted by law.
76. Customer Acceptance
By submitting an order or payment, Customer confirms that Customer:
Has read these Terms;
Understands the nature of the Service;
Understands that Google and Apple are independent third parties;
Understands that Google Play or App Store approval is not guaranteed;
Understands that Apple Developer membership remains subject to Apple's verification and approval;
Will provide truthful information;
Has the necessary rights in the Application;
Agrees to the Privacy Policy;
Agrees to be legally bound by these Terms.
